This End User License Agreement (“EULA”) is a legally binding agreement between you and Mission H LLC (“Mission H,” “we,” “our,” or “us”) governing your use of the Riffle application (“Riffle” or the “Application”), a documentation synchronization tool that enables bidirectional sync between Atlassian Confluence and GitHub repositories.

By installing, accessing, or using Riffle through the Atlassian Marketplace, you acknowledge that you have read, understand, and agree to be bound by this EULA. If you do not agree to this EULA, do not install or use Riffle.

If you are accepting this EULA on behalf of your employer or another legal entity, you represent and warrant that you have full legal authority to bind that entity to this EULA. In such event, “you” and “your” refer to that entity.

This EULA supplements our Terms of Service and Privacy Policy, which are incorporated herein by reference. In the event of a conflict between this EULA and the Terms of Service, the Terms of Service shall govern.

1. License Grant

Subject to your compliance with this EULA and the Terms of Service, Mission H grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use Riffle as a hosted service through the Atlassian Forge platform. Riffle is provided as a Software-as-a-Service (SaaS) application — no software is downloaded to or installed on your local systems. Your right to use Riffle is contingent upon your valid subscription through the Atlassian Marketplace.

2. Restrictions

You agree not to, and will not permit any third party to:

copy, modify, adapt, translate, or create derivative works based on Riffle;
reverse engineer, disassemble, decompile, or otherwise attempt to derive the source code or underlying algorithms of Riffle;
rent, lease, lend, sell, sublicense, distribute, or otherwise transfer access to Riffle to any third party;
remove, alter, or obscure any proprietary notices, labels, or marks on or in Riffle;
use Riffle to build a competing product or service;
use Riffle in any manner that violates applicable law or the Terms of Service; or
circumvent or attempt to circumvent any access controls, usage limits, or security measures of Riffle.

3. Intellectual Property

Riffle, including all associated technology, documentation, designs, trademarks, and other intellectual property, is and remains the exclusive property of Mission H or its licensors. This EULA does not convey to you any ownership interest in or to Riffle, but only a limited right of use subject to the terms herein.

You retain all rights to your content (“User Content”) that you configure for synchronization through Riffle. Mission H claims no ownership over your User Content.

4. Data Handling

Your use of Riffle involves the processing of data as described in our Privacy Policy. By using Riffle, you acknowledge and agree that:

Riffle stores configuration and synchronization state data within Atlassian’s Forge platform infrastructure, scoped to your Confluence instance.
Content synchronized by Riffle is transmitted to and stored in GitHub repositories that you configure, subject to GitHub’s privacy policy and your repository access controls.
Mission H does not maintain external databases or servers for the purpose of storing your content data.
Mission H does not use your content data to train machine learning models or other models where your data could be exposed to third parties.

5. Third-Party Platforms

Riffle integrates with Atlassian Confluence and GitHub. Your use of these third-party platforms is governed by their respective terms of service and privacy policies. You are solely responsible for maintaining valid accounts and complying with the terms of these third-party platforms. Mission H is not responsible for the availability, accuracy, or conduct of any third-party platform.

6. Billing and Subscription

Riffle is distributed through the Atlassian Marketplace. All billing, subscription management, and payment processing are handled by Atlassian in accordance with the Atlassian Marketplace Terms of Use. Mission H is not a party to your payment relationship with Atlassian.

7. Disclaimer of Warranties

RIFFLE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MISSION H DOES NOT WARRANT THAT RIFFLE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

MISSION H DOES NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR TIMELINESS OF SYNCHRONIZED CONTENT. YOU ARE RESPONSIBLE FOR VERIFYING THAT CONTENT HAS BEEN CORRECTLY SYNCHRONIZED BETWEEN YOUR CONNECTED PLATFORMS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MISSION H, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, OR COMPUTER DAMAGE, ARISING OUT OF OR IN CONNECTION WITH THIS EULA OR YOUR USE OF OR INABILITY TO USE RIFFLE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IF, NOTWITHSTANDING THE FOREGOING, MISSION H IS FOUND LIABLE, OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE LESSER OF (I) THE TOTAL FEES PAID BY YOU TO MISSION H FOR RIFFLE DURING THE SIX (6) MONTHS PRECEDING THE CLAIM OR (II) ONE HUNDRED DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

9. Indemnification

You agree to indemnify, defend, and hold harmless Mission H and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with (i) your use of Riffle, (ii) your breach of this EULA or the Terms of Service, (iii) your violation of any law or the rights of any third party, or (iv) your User Content.

10. Termination

This EULA is effective until terminated. You may terminate this EULA at any time by uninstalling Riffle from your Atlassian instance via the Atlassian Marketplace.

Mission H may terminate or suspend your access to Riffle at any time, with or without cause, including if we reasonably believe you have violated this EULA or the Terms of Service.

Upon termination:

Your license to use Riffle ceases immediately.
All configuration and synchronization state data stored within Forge will be removed upon uninstallation.
Markdown files previously committed to your GitHub repositories remain under your control and can be deleted at your discretion.

Sections 3, 7, 8, 9, and 11–13 shall survive any termination of this EULA.

11. Dispute Resolution

Any disputes arising out of or relating to this EULA shall be resolved in accordance with the dispute resolution provisions set forth in Section 15 of our Terms of Service, including the binding arbitration and class action waiver provisions contained therein.

12. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in the Commonwealth of Massachusetts.

13. General

Entire Agreement. This EULA, together with the Terms of Service and Privacy Policy, constitutes the entire agreement between you and Mission H with respect to your use of Riffle.
Severability. If any provision of this EULA is held to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
Assignment. You may not assign this EULA without Mission H’s prior written consent. Mission H may assign this EULA without restriction.
No Waiver. Mission H’s failure to enforce any right or provision of this EULA shall not constitute a waiver of such right or provision.
Updates to This EULA. We may update this EULA from time to time. We will notify you of material changes by posting the updated EULA and revising the “Last Updated” date. Your continued use of Riffle after such changes constitutes acceptance of the updated EULA.
